By using MonsterMedia LLC (z93 KLJZ FM &/or KJOK AM herein after referred
to as MML) you agree to the following terms of service. We've tried to make
them as simple as possible, while protecting our rights and those of our users.
1. MML has made available to the community a web site featuring news, bulletin boards, classifieds, advertising, and a lot of other information. This site is the property of MML ,and MML may determine its own editorial policy for the site.
2. Anything you post on MML is your responsibility.
3. You acknowledge and agree to the MML Privacy Policy.
4. MML has sole discretion of interpreting these rules and determining compliance.
5. You agree not to post content that is illegal, threatening, abusive, defamatory, pornographic, deceptive, false, misleading, or disruptive. These terms are defined at MML discretion.
6. You agree not to send unsolicited commercial email to addresses on MML or through our computers. You agree not to post advertising or commercial messages except in areas reserved for ads. The definition of advertising and commercials is at our discretion.
7. MML can set limits on what you can do on our system, how much you can post to it, and how often you can use it. We can deactivate your account, block your address, or otherwise keep you off the system at our discretion. We don't take any responsibility for information that is lost or deleted from the system.
8. You agree to accept responsibility for your dealings with other users and not to hold MML responsible for the conduct of people you've met through our site.
9 You agree to give us the right to reproduce on MML any content you post on the site. You agree for your postings to be covered by our Creative Commons License.

12. MML may change these rules at any time.
a) All postings, messages, text, files, images, graphics, photos, audio clips, sounds, video or other materials (the "Content") posted on, transmitted through, or linked from the Site, are the sole responsibility of the person from whom such Content originated. You are entirely responsible for all Content that you post, email or otherwise make available through the Site. For all Content provided by you, you agree to indemnify Provider as provided below.
b) By uploading or otherwise posting any Content on the Site, you represent and warrant: (i) you own or otherwise have all necessary rights, including but not limited to copyrights, to the content you provide and the rights to use it as provided in these Terms of Use; (ii) all information you provide is true, accurate, current and complete, and does not violate these Terms of Use; and, (iii) the content will not cause injury to any person or entity.
c) This is a community site. As such, there are web logs, forums, photo galleries and other interactive areas where users can express opinions and share ideas and information. MML will monitor all of the material posted or transmitted to the site. Additionally, MML Does not control, and is not responsible for, content made available through the site by members.
d) You also agree that under no circumstances will MML or its affiliates be
liable in any way for any Content or for any loss or damage of any kind incurred
as a result of the use of any content posted, emailed or otherwise made available
via the site. You acknowledge that provider pre-screens and approves all cxontent,
and that MML shall have the right (but not the obligation) in its sole discretion
to refuse, delete or move any Content that is available via the site, for violating
the letter or spirit of the terms or for any other reason. MML reserves the
right to delete any posting, message or photograph at any time, for any reason
or no reason.
13. You agree not to post, email, or otherwise make available content:
a) That is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic,
libelous, or invasive of another's privacy, or harms minors (18 years of age
and younger) in any way;
b) That harasses, degrades, intimidates or is hateful toward an individual or
group of individuals on the basis of religion, gender, sexual orientation, race,
ethnicity, age, or disability;
c) That purports to be from any person or entity, including but not limited
to a provider employee, or falsely states or otherwise misrepresents your affiliation
with a person or entity;
d) That includes personal or identifying information about another person without
that person's explicit consent or guardians consent if minor(under the age of
18, see pg 6 Minor);
e) That is false, deceptive, misleading, deceitful, mis-informative, or constitutes
"bait and switch";
f) That infringes any patent, trademark, trade secret, copyright or other proprietary
rights of any party, or Content that you do not have a right to make available
under any law or under contractual or fiduciary relationships;
g) That constitutes or contains "affiliate marketing," "link
referral code," "junk mail," "spam,"
"chain letters," "pyramid schemes," or unsolicited commercial
advertisement;
h) That constitutes or contains any form of advertising or solicitation if (1)
posted in areas which are not designated for such purposes; or (2) emailed to
MML users who have requested not to be contacted about other services, products
or commercial interests;
i) That advertises any illegal services or the sale of any items the sale of
which is prohibited or restricted by applicable law, including without limitation
items the sale of which is prohibited or regulated by Arizona law;
j) That contains software viruses or any other computer code, files or programs
designed to interrupt, destroy or limit the functionality of any computer software
or hardware or telecommunications equipment;
k) That disrupts the normal flow of dialogue with an excessive number of messages
(flooding attack) to the service, or that otherwise negatively affects other
users' ability to use the service; or
l) That employs misleading email addresses, or forged headers or otherwise manipulated
identifiers in order to disguise the origin of content transmitted through the
service.
14. Additionally, you agree not to:
a) Contact anyone who has asked not to be contacted;
b) "Stalk" or otherwise harass anyone;
c) Collect personal data about other users for commercial or unlawful purposes;
d) Use automated means, including scripts, spiders, robots, crawlers, data mining
tools, or the like to download data from or upload data to the service;
e) Post irrelevant content, repeatedly post the same or similar content or otherwise
impose an unreasonable or disproportionately large load on our infrastructure;
f) Attempt to gain unauthorized access to MML computer systems or any other
user's computer systems, or engage in any activity that disrupts, diminishes
the quality of, interferes with the performance of, or impairs the functionality
of, the Service or the MML website.
INTERACTIVE FEATURES
15. This Service may include a variety of features, such as bulletin boards, web logs, chat rooms, and email services, which allow feedback to MML and real-time interaction between users, and other features, such as personalized homes pages and email services, which allow users to communicate with others. Responsibility for what is posted on bulletin boards, web logs, chat rooms and other public posting areas on the service lies with each user - you alone are responsible for the material you post. MML does not control the messages, information or files that you or others may provide through the service. It is a condition of your use of the service that you do not:
a) Restrict or inhibit any other user from using and enjoying the service.
b) Use the service to post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law.
c) Use the service to post or transmit any information, software or other material that violates or infringes upon the rights of others, including material that is an invasion of privacy or publicity rights or that is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or rights holder.
d) Use the service to post or transmit any information, software or other material that contains a virus or other harmful component.
e) Use the service to post, transmit or in any way exploit any information, software or other material for commercial purposes, or that contains advertising.
TERMINATION
16. MML may cancel or terminate your right to use the service or any part of
the service at any time without notice. In the event of termination, you are
no longer authorized to access the part of the service affected by such cancellation
or termination. The restrictions imposed on you with respect to material downloaded
from the service, and the disclaimers and limitations of liabilities set forth
in these Terms of Use, shall survive.
OTHER
17. This agreement constitutes the entire agreement between MML and you with
respect to the subject matter contained in this agreement and supersedes all
previous and contemporaneous agreements, proposals and communications, written
and oral. You also may be subject to additional terms and conditions that may
apply when you use the products or services of a third party that are provided
through the service. In the event of any conflict between any such third-party
terms and conditions, these Terms of Use shall govern. This agreement shall
be governed by and construed in accordance with the laws of the State of Arizona
without giving effect to any principles or conflicts of law. If any provision
of this agreement shall be unlawful, void or for any reason unenforceable, then
that provision shall be deemed severable from this agreement and shall not affect
the validity and enforceability of any remaining provisions of this agreement
which shall remain in full force and effect.
MINOR
18. Minors are considered all those under the age of 18.
